CONVIRTIENDO, O.E., in compliance with current regulations regarding the protection of personal data, informs that the personal data collected through the forms on the website www.convirtiendo.net are included in specific automated files for users of the digital marketing and web development services.
The collection and automated processing of personal data are aimed at maintaining the commercial relationship and performing tasks related to information, consultancy, creation, and other activities inherent to digital marketing as a whole.

- In the case of contracting the services offered through www.convirtiendo.net or specific quotes agreed upon for each client, to maintain the contractual relationship, as well as the management, administration, provision, and improvement of the service.

- Sending newsletters and commercial communications related to promotions and/or advertising of Convirtiendo and the digital marketing sector.
We remind you that you may object to receiving commercial communications through any channel at any time by sending an email to the address mentioned above.
The completion of these fields is mandatory, and it is impossible to carry out the stated purposes without providing the required data.
How long will the collected personal data be kept?
The personal data provided will be retained as long as the commercial relationship is maintained or you do not request their deletion and for the period in which legal obligations may arise from the services provided.
Legal Basis
The processing of your data is carried out based on the following legal grounds:
- The request for information and/or the contracting of digital marketing and/or web development services, whose terms and conditions will be made available to you in any case, prior to a potential agreement.

Data Collected by Users of the Services
In cases where the user includes files containing personal data on the shared hosting servers, CONVIRTIENDO, O.E. shall not be held responsible for the user’s failure to comply with the GDPR.
Data Retention in Compliance with the LSSI
CONVIRTIENDO, O.E. informs that, as a data hosting service provider and in accordance with the provisions of Law 34/2002 of July 11, on Services of the Information Society and Electronic Commerce (LSSI), it retains for a maximum period of 12 months the information strictly necessary to identify the origin of the hosted data and the moment in which the service provision began. The retention of this data does not affect the confidentiality of communications and may only be used within the framework of a criminal investigation or to safeguard public security, being made available to judges and/or courts or the Ministry that may require it.
The communication of data to State Security Forces and Corps will be carried out in accordance with the regulations on personal data protection.
Intellectual Property Rights
CONVIRTIENDO, O.E. holds all copyright, intellectual and industrial property rights, “know-how,” and all other rights related to the contents of the website www.convirtiendo.net and the services offered therein, as well as the programs necessary for its implementation and the related information.
Reproduction, publication, and/or use of the contents, in whole or in part, of the website www.convirtiendo.net for anything other than strictly private use is not permitted without prior written consent.
Software Intellectual Property
The user must respect third-party software made available by CONVIRTIENDO, O.E., even if such software is free and/or publicly accessible. CONVIRTIENDO, O.E. holds the necessary exploitation and intellectual property rights over the software.
The user does not acquire any rights or license for the contracted service, over the software necessary for the provision of the service, nor over the technical monitoring information of the service, except for the rights and licenses necessary for the fulfillment of the contracted services and only for the duration thereof.
For any action that goes beyond the scope of the contract, the user will need written authorization from CONVIRTIENDO, O.E. The user is prohibited from accessing, modifying, or viewing the configuration, structure, and files of the servers owned by CONVIRTIENDO, O.E., and assumes full civil and criminal liability for any incident that may occur in the servers and security systems as a direct result of negligent or malicious behavior.
Intellectual Property of Hosted Content
The use of the services provided by CONVIRTIENDO, O.E. in ways that violate intellectual property laws is strictly prohibited, particularly:
Use that is contrary to Spanish law or that infringes the rights of third parties.
The publication or transmission of any content that, in the judgment of CONVIRTIENDO, O.E., is violent, obscene, abusive, illegal, racist, xenophobic, or defamatory.
Any content that infringes on third-party intellectual property rights.
The collection and/or use of personal data of other users without their express consent or in violation of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, concerning the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
The use of the domain’s mail server and email addresses for sending unsolicited mass emails (spam).
The user is fully responsible for the content of their website, the information transmitted and stored, hyperlinks, third-party claims, and legal actions relating to intellectual property.
Third-Party Rights and Protection of Minors
The user is responsible for complying with applicable laws and regulations, as well as the rules related to the operation of the online service, e-commerce, copyright, public order, and the universal principles governing Internet use.
The user shall indemnify CONVIRTIENDO, O.E. for any expenses resulting from being held liable in any case attributable to the user, including legal fees and costs, even in the event of a non-final judicial decision.
Protection of Hosted Information
CONVIRTIENDO, O.E. makes backup copies of the content hosted on its servers; however, it shall not be held responsible for the loss or accidental deletion of data by third parties. Likewise, it does not guarantee the complete restoration of deleted data, as such data may have been removed and/or modified since the last backup was made.
The services offered, except those specifically for backup, do not include the restoration of content preserved in the backup copies made by CONVIRTIENDO, O.E. when the loss is attributable to the user; in this case, a fee will be determined based on the complexity and volume of the recovery, subject to the user’s prior acceptance.
The restoration of deleted data is only included in the service price when the content loss is due to causes attributable to CONVIRTIENDO, O.E.
Commercial Communications
In accordance with the LSSI, CONVIRTIENDO, O.E. will not send advertising or promotional communications by email or any other equivalent electronic means that have not been previously requested or expressly authorized by the recipients.
In the case of users with whom there is a prior contractual relationship, CONVIRTIENDO, O.E. is authorized to send commercial communications regarding digital marketing and web development products or services that are similar to those initially contracted by the client.
In any case, the user, after verifying their identity, may request not to receive further commercial information through the Customer Service channels.
